Return of goods

Right of withdrawal (applies to natural persons).

The buyer – a natural person has the right to unilaterally exercise the right of withdrawal and withdraw from the contract of purchase of goods concluded in the online store veikals.energrid.lv. The right of withdrawal may be exercised in accordance with the procedure set out in the regulatory enactments, these Terms of Use and other applicable terms and conditions issued by veikals.energrid.lv. The right of withdrawal may be exercised only by the Buyer who is recognised as a consumer under the laws and regulations, i.e. a natural person who wishes to purchase or has purchased a good or service for a purpose unrelated to his/her business or professional activity.

The buyer (consumer) has the right to withdraw from the ordered goods within 14 days by notifying veikals.energrid.lv Customer Service (see Contacts section). The Buyer may submit a free-form notification stating the Buyer’s name, contact telephone number, the date of the order and the product/service for which the Buyer has exercised the right of withdrawal.

The Buyer is responsible for maintaining the quality and safety of the goods during the exercise of the right of withdrawal until the goods are returned to the Seller.

The delivery charge, if any, shall not be refunded to the Buyer.

The Buyer is responsible for the direct costs of returning such goods.

The Buyer cannot exercise the right of withdrawal if:

  1. the provision of the service which was started before the expiry of the right of withdrawal has been fully completed, provided that the Buyer has expressly agreed and confirmed that he will lose the right of withdrawal from the date on which the contract for the provision of the service has been fully performed. This rule does not apply to contracts where the subject-matter of the contract includes both a good and a service;
  2. the price of the goods or services is subject to fluctuations in the financial market which are beyond the Seller’s control and which may occur during the period of the right of withdrawal;
  3. the goods are made to the Buyer’s specifications or are clearly personalised;
  4. the buyer has opened the packaging of a product that cannot be returned for health and hygiene reasons;
  5. the consumer has asked the seller or service provider to come and carry out urgent repairs or maintenance Where the seller or service provider provides, upon the consumer’s arrival, an additional service or goods other than the necessary spare parts for the repair or maintenance work, the right of withdrawal applies to those additional services or goods;
  6. Other 20.05.2014. g. Cabinet of Ministers Regulation No.255 “Regulations on Distance Contracts” in the cases provided for.

Return and exchange of goods (applies to natural persons).

Return of the Goods if the Buyer has exercised the Right of Withdrawal:

Goods which have been rejected by the Buyer and delivered must be returned within 14 days of receipt. The goods must be in their original packaging, unopened. Goods must be free from torn or damaged labels, protective films, etc. The goods must be returned in their complete condition and with the instructions for use and the accompanying utaml. If the Buyer cannot meet these requirements, sunsparki.lv reserves the right not to refund the Buyer for the returned goods. Return of goods not in conformity with the contract, warranty service:

An application for the return of a product that does not comply with the contract must be made in accordance with the procedure laid down in the Consumer Rights Protection Law.

The legal entity buyer shall apply in accordance with the procedure set out in the contract concluded between the parties, but in the absence of such procedure, non-conforming goods shall be applied for in accordance with the procedure set out in the Regulations, insofar as the rights of consumers are not exclusively covered by the Regulations.

If the Buyer, after receipt of the order, has found that the goods are damaged and/or of poor quality, the Buyer shall contact the Customer Service by writing to [email protected], describing the damage to the goods and attaching a photograph of the damaged goods.

Goods which have expired and are found to be defective may be returned by the Buyer within the expiry/warranty period.

The Buyer shall return the Goods at its own expense by sending them by post to SIA EnerGrid, address Uriekstes iela 2a, Riga, LV-1005, Latvia, or deliver them to the Seller’s warehouse, address Patversmes iela 18 Riga, LV-1005, having agreed with the Seller the time of return. By agreement with the Seller, the goods may be handed over to the Seller’s representative (courier).

The Buyer’s complaints shall be considered within 15 (fifteen) days from the date of receipt of the complaint. If for objective reasons it is not possible to reply to the Buyer’s complaint within that period, the Seller shall immediately inform the Buyer in writing, stating the need for an extension and a reasonable period within which a reply will be provided. The duration of the warranty service is between 7 and 30 (seven to thirty) calendar days. In all cases, the Seller will endeavour to complete the warranty service process in the shortest possible time.

The buyer is liable for any diminution in the value of the goods if they are used in a way that is incompatible with the principle of good faith, including for a purpose other than ascertaining the nature or performance of the goods. Used goods, goods that cannot be returned for hygienic reasons because their packaging has been opened, goods that are not complete and goods that have been damaged by improper storage of the goods by the Buyer are not accepted. Goods must be returned properly packaged in their original packaging and in their complete condition. If the goods do not comply with the above, the Seller has the right not to accept the goods and not to refund the money paid by the Buyer for the goods.

The Buyer may agree with the Seller to exchange the goods.

The price of the goods returned by the Buyer to the Seller in accordance with the established procedure, by exercising the right of withdrawal or due to non-conformity of the goods with the contract, shall be refunded by the Seller to the Buyer within thirty days after acceptance of the goods. The refund is made using the same means of payment as the customer used for the transaction.

The Buyer shall bear the costs of returning the goods, except in the case of return of goods which do not comply with the terms of the contract.

If any of the ordered goods are not delivered, the value of the goods will be refunded by bank transfer to the account specified in the Customer’s customer profile within 3-5 working days. Refund information will be sent to the email address provided in the Buyer’s customer profile.
